TERMS AND CONDITIONS
Fistral Surf Holiday Accommodation
4 Fistral Court, Newquay, Cornwall, TR7 1PD.
Bookings are made and accepted only on the following conditions.
HOLIDAY TENANCY
This agreement is made on the basis that Fistral Surf Holiday Accommodation is to be occupied by the Tenant for the purpose of holiday only as mentioned in The Housing Act 1988 Schedule 1 paragraph 9 and the Tennant acknowledges that the tenancy granted by this agreement is not an assured tenancy and that no statutory periodic tenancy will arise when it ends.
GOOD HOUSE KEEPING BOND
A bond of £100 must be paid to cover losses, breakages and if necessary extra cleaning. In most cases this is returned in full one week after departure when the property has been checked.
PAYMENT OF BALANCE
The Guest is responsible for payment of balance and good housekeeping bond once a booking has been confirmed.
NON-PAYMENT OF BALANCE
The balance and bond must be sent to reach us no later than four weeks before commencement of holiday. If it is not received by this time, we reserve the right to re-advertise your dates and retain your deposit.
However if we are unable to relet the holiday you will remain liable for the balance.
LATE BOOKINGS
Bookings made less than six weeks before commencement of holiday must be paid in full.
ACCOMMODATION BECOMING UNAVAILABLE
If the property becomes unavailable, through extreme damage or other unforeseen circumstance, we will try to provide alternative accommodation or refund all paid monies or a proportion if your start date is delayed.
CANCELLATION
If you have to cancel your holiday and you are uninsured we will try to relet the property. If successful your balance will not be required. If you have paid in full, your balance will be refunded, however your deposit will be retained.
INSURANCE
We recommend you take your own holiday insurance to cover cancellations, damage, loss etc. of personal property (including vehicle) as we cannot accept responsibility or liability for personal injury sustained.
BREAKAGES/ DAMAGE
The head of party is responsible to us for any breakages or damage to Fistral Surf Holiday Home and shall keep the accommodation along with all fixtures fittings furniture and effects in the same state of repair as found on arrival. The same state of cleanliness and general order shall be left as was found on arrival. Any breakages or damage must be reported to us during your occupancy.
BREACH OF TERMS AND CONDITIONS
You may give up your right to occupy the property without compensation if;
(a) You cause unreasonable noise damage or disturbance
(b) More people than named on the booking form are in occupancy.
(c) Extra overnight guests are entertained without our permission.
COMPLAINTS
If you have a complaint about the property, you should contact us at once whilst you are still at the property so that we can carry out an on-the-spot investigation and take remedial action if necessary. Compensation will not be paid if you have denied us the opportunity to put it right by making the complaint after your departure.
OWNER ACCESSS
The owner shall be allowed to access the property at any reasonable time during your occupancy.
PETS
Clean, well-behaved dogs are welcome but please do not allow them to sleep on beds or furniture. All other pets are forbidden.
ARRIVAL AND DEPARTURE
We like to present the property to you in top condition; this takes us several hours to prepare every Saturday so we would ask you not to arrive before 3pm and to depart by 10am.
SMOKING
Fistral Surf Holiday Home operates a no smoking policy.
